Acceptance and changes

These Terms of Use govern your use of excocommercial.com (the "Site"), operated by EXCO Commercial, LLC ("EXCO Commercial", "we", "us"). By using the Site or submitting the inquiry form you accept these Terms. We may change them at any time by posting a revised version with a new effective date; continued use after that date means you accept the revision.

You may not copy, scrape or republish Site content except for personal or internal business reference; interfere with the Site, its hosting or its security; submit false, misleading, unlawful or infringing material through the form; use automated means to submit inquiries; or use the Site to send unsolicited commercial messages.

Intellectual property and trademarks

The Site and its content, including text, design, graphics and code, are owned by EXCO Commercial or its licensors and are protected by copyright and other laws. StableHOCL™ and the EXCO name and marks are trademarks of EXCO Sciences and its affiliates, used by EXCO Commercial under license. Unsolicited submissions

Do not submit confidential, proprietary or unpublished technical information. If you have technology or intellectual property to propose, use the EXCO Sciences intake process, which the form directs you to; that process may offer a confidentiality agreement before technical detail is exchanged.

Forward-looking and research statements

Statements on the Site about plans, pathways, markets, research programs and future availability are forward-looking and may change without notice. Research and validation programs described on the Site are not commercial offerings, and no efficacy or suitability is claimed or implied for any use that is not covered by the applicable product registration and label.

Third-party and affiliated sites

The Site links to other websites, including sites operated by other EXCO companies and by third parties such as manufacturing partners. Those sites have their own terms and privacy policies, and we are not responsible for their content or practices. A link is not an endorsement.

Disclaimers

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, EXCO Commercial and its affiliates, officers, members, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of business, profits, data or goodwill, arising from your use of or inability to use the Site, even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred US dollars. Some jurisdictions do not allow certain limitations, in which case these limits apply to the extent permitted.

Indemnity

You agree to indemnify and hold harmless EXCO Commercial and its affiliates from any claim, loss or expense, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site, including any material you submit.

Export and sanctions compliance

You may not use the Site, or submit an inquiry, in violation of applicable export control or economic sanctions laws, including those of the United States. By submitting an inquiry you confirm that you and your organization are not located in, organized under the laws of, or ordinarily resident in a country or territory subject to comprehensive US sanctions, and are not on any US government restricted-party list.

Governing law and venue
